Before a brochure goes out on WhatsApp: the Trakheesi permit check, and who owns it

The short answer

Does a property brochure sent on WhatsApp need a Trakheesi permit?

DLD's permit service lists SMS and electronic advertisements, and RERA fines a missing QR code AED 50,000. Its pages do not say whether a private one-to-one WhatsApp reply counts, so ask RERA in writing. At Mindcat, we treat every brochure, floor plan or price sent to a lead as marketing the unit.

Takeaways

  1. 01DLD's permit service lists SMS and electronic ads. Treat a brochure sent to a lead as marketing the unit until RERA says otherwise.
  2. 02RERA inspects four things: QR code present, data matching, permit valid, permit issued to the advertiser.
  3. 03On personal phones nobody can show which permit went with which message. The fix is a named owner and a field on the lead.
  4. 04Test it this week: take your ten most-sent WhatsApp attachments and find each one's permit number.

Does a WhatsApp brochure need a permit?

If your brokers send brochures from their own phones and nobody can say which permit went with which message, this is for you.

A lead from a portal ad asks about a two-bedroom in Marina. The broker replies with a PDF brochure, a floor plan and a price. The ad on the portal had a permit number and a QR code. Did the PDF?

The rule you can read is short. The Dubai Land Department's Real Estate Ad Permit service lists fourteen kinds of advertising permit, and two of them are SMS advertisements and electronic advertisements. RERA's Brokerage Practice Guide says a brokerage must obtain a permit for any real estate advertisement or marketing material, and that the permit number must be displayed on the ad. Circular 02-2023 added the QR code from 15 April 2023, and it states the fine for not following it: AED 50,000.

What the pages do not say is whether a private, one-to-one WhatsApp reply counts as an advertisement. That is a question for RERA or your counsel, in writing. A two-line version your admin can send today: "Does a brochure, floor plan or price sent to one lead on WhatsApp need the permit number and QR code? Does it matter whether the lead asked for it?" Until you have the answer, treat any brochure, floor plan or price you send to a lead as marketing the unit, and give it the same check as the portal ad. The check is a look at the file before you send it. The fine RERA states for breaking its QR circular is AED 50,000, and its circular addresses the brokerage firm.

If you want the check recorded on the lead, not remembered, Mindcat Inbox keeps the permit and the QR check beside the chat.

What do DLD inspectors check?

Four things, in DLD's own words. In its December 2023 release, the head of RERA's control department listed the standards for inspecting an ad: the code is present, the advertised data matches the code data, the permit is valid, and the permit was issued to the same company that is advertising.

DLD also reported how that played out. 411,608 permits had been issued with a QR code since April 2023. Only five violations were recorded, 1,980 warnings had been issued, and DLD said it would enforce fines directly, without a prior warning. In February 2024 it fined 30 real estate companies AED 50,000 each.

DLD checks (December 2023)What it means for a WhatsApp sendWho can fail it
The QR code is on the adThe PDF or image shows the permit's QR code, readable when scannedAnyone who re-exports the brochure without it
The advertised data matches the codePrice, size and unit in the message match what the permit saysA broker who pastes a newer price into the caption
The permit is validThe permit has not reached its end dateA brochure saved weeks ago and sent again
Issued to the same companyThe permit belongs to your brokerage, not to a colleague's firm or a developer'sA forwarded brochure from another agency
Four checks: QR code on the file, price and unit match, permit not ended, permit in your company name
The four checks, applied to a file before it is sent.

DLD's October 2020 release names three kinds of violation: no permit, manipulating a permit number, and using an expired permit. A brochure that lives on a phone for a month is the easiest way to commit the third.

Where does the check fail?

On the broker's own phone. The portal has a field for the permit and the portal checks it. WhatsApp has no field. The brochure is an attachment, the caption is free text, and the only record that anyone looked is the broker's memory.

That is fine until a manager has to answer a simple question: which permit went with the PDF that was sent to this lead on Tuesday? If the broker has left, if the chat sits on a personal number, or if the answer is "the usual one", there is no answer.

Three failures repeat on a desk like this:

  1. The saved copy. A brochure from last month, with last month's price and a permit that has since ended.
  2. The forward. A developer's or another agency's PDF, with their permit, sent as yours.
  3. The re-export. A screenshot or a trimmed PDF that lost the QR code.

None of these is a lie. All three are what a desk of ten brokers produces in a normal week.

What is the ten-attachment test?

A test you can run on your own desk: take last week's ten most-sent WhatsApp attachments and find each one's permit number. It is not a DLD procedure, and it takes about an hour.

For each of the ten, write down:

  • the permit number printed on the file, or none;
  • whether the QR code scans to a live permit;
  • the permit's end date;
  • whether the permit was issued to your company;
  • who sent it, and to how many leads.
The ten-attachment test as five steps, from taking ten files to finding the step with no owner
The ten-attachment test, as a checklist.

Score yourself honestly. If all ten pass, your desk already runs the check and the rest of this post is a safety net. If some fail, you have found the step that has no owner, and you know which file to fix first. If a failed file has already gone to leads, pull it from the shared folder today, send the corrected file to those leads, and note it on each lead.

Who should own the check?

One named person per brokerage, with one step per send. A rule everyone follows "when they remember" has no owner.

The decision rule we give a brokerage is simple. A WhatsApp brochure, floor plan or price sent to a lead is part of how you market the unit, so it gets the same permit and QR check as the portal ad, and the check is a step with a person's name on it. Which person depends on the desk:

  • Under ten brokers: the sales manager, once a week, on the ten most-sent files, the same test as above.
  • Ten or more: a compliance or admin lead who keeps the approved brochure for each live permit, and brokers send only those files.
  • Any size: the broker records the check on the lead when they send, so the manager can search it later.

A rule you can paste to the desk: send only files from the approved folder, look at the end date when you send, and note the permit on the lead. The third line is the one a shared inbox changes. A folder and a rule get you the first two for free. A personal phone cannot make the record searchable by lead or keep it when a broker leaves. A company number with a field on the lead can.

What does Mindcat Inbox record?

At Mindcat, we set up the lead panel in Mindcat Inbox with the Trakheesi permit number, a Madmoun QR checked field, and a private note the buyer never sees. These fields are added during setup. They record what your broker checked. They do not look anything up with DLD or REGA, and they do not file anything with them.

A real screen of Mindcat Inbox with sample data. The lead, the private note and the permit number are invented.

What your manager gets is a trail. For any lead, they open the conversation and see the permit recorded, who recorded it and what was sent. That is the answer to Tuesday's question, and it stays when a broker leaves, because the chat sits on the company number.

Inbox is priced per agent a month, in bands: AED 89 for agents 1 to 5 and AED 59 for agents 6 to 20, with a shared-plan minimum of 3 agents (AED 267 a month). Setup is separate, and Meta's WhatsApp fees are billed at cost to your own account. The product page has the full table.

If you work from leads that need a promised reply time and a ticket, that is a different job: it belongs to Desk. Sales leads go to Inbox.

When is this not for you?

Not for teams with no one who owns the lead after the first reply. A field cannot fix a lead nobody picks up.

It is also not for you if your brokers reply inside the portal's own app and WhatsApp is a side channel. Count the leads that start on WhatsApp in a week. If the number is small, run the ten-attachment test on whatever you do send, fix those files, and wait on a shared inbox. Our WATI comparison and our real estate CRM post cover the next step when the count grows.

Start with the test. Ten files, one hour, one name on the check.

FAQ

Questions teams ask next

How much is the fine for a missing QR code on a Dubai property ad?
RERA's Circular 02-2023 sets the fine at AED 50,000 and required the QR code on real estate ads, print or audiovisual, from 15 April 2023. In February 2024 DLD reported fining 30 real estate companies AED 50,000 each for breaking its advertising terms, and repeated that the QR code is obligatory.
Does a private WhatsApp reply to one lead count as an advertisement?
DLD's pages do not say. Its permit service lists SMS advertisements and electronic advertisements among the permit types, and its 2022 terms say a company marketing through portals or social media channels needs a permit and must show the number. Ask RERA in writing, keep the reply, and until then treat brochures as covered.
Can a brochure carry an expired permit?
No. In its October 2020 release DLD named three kinds of violation: no permit, manipulating a permit number, and using an expired permit. A brochure saved on a phone in March can still be sent in October, so the permit's end date needs checking at the time of sending.
Does Mindcat Inbox check a permit with DLD?
No. It records the permit number and that your agent checked the QR code, on the lead, with a private note the buyer never sees. DLD and the portals do the checking. Inbox shows your manager what was recorded and by whom.
